Terms and Conditions

These Terms and Conditions ("Terms") govern the use of services provided by DS Infra Developers, a real estate development company based in Lucknow, Uttar Pradesh. By engaging with our services, visiting our site, purchasing or booking property through us, or entering into any contractual agreement, you agree to abide by these Terms. If you do not accept these Terms, you are advised not to continue using our services.

1. Company Information

DS Infra Developers, established in 2020, is a real estate development company dealing in residential plots, villas, row houses, farmhouses, and commercial properties in and around Lucknow. We are committed to providing legal, RERA-compliant, and investment-friendly real estate opportunities.


2. Eligibility

To access our properties or services:

  • You must be at least 18 years of age.

  • You must be legally competent to enter into a binding contract under the Indian Contract Act, 1872.

  • If you are acting on behalf of a company or organization, you must be duly authorized to represent and bind them.


3. Property Booking and Payment Terms

  • Property bookings are accepted through written application or formal communication.

  • A booking amount as declared per project must be paid to reserve the property.

  • Booking is subject to clearance of the cheque/payment and receipt acknowledgment from DS Infra Developers.

  • Full or part payment can be made via bank transfer, demand draft, UPI, cheque, or cash (as per prevailing government guidelines and legal limits).

  • The final price of the property shall be confirmed via a Sale Agreement or Allotment Letter issued to the buyer.


4. Project Details and Modification Rights

  • All images, layouts, location maps, and brochures shared are conceptual and for representational purposes only.

  • DS Infra Developers reserves the right to make changes in layout, specification, features, or amenities without prior notice as per government norms or project feasibility.

  • Any modifications will be in accordance with rules and regulations applicable under the Real Estate (Regulation and Development) Act, 2016 (RERA).


5. Registration and Legal Documentation

  • Registry (sale deed) will be executed after full payment and clearance of all dues.

  • The buyer is responsible for paying stamp duty, registration charges, and any applicable taxes as per the prevailing state norms.

  • DS Infra Developers ensures clear title and legally verified land; however, clients are advised to conduct due diligence or consult with a legal expert before proceeding with the final registry.

  • No oral promise or assurance will be binding unless confirmed in writing.


6. Possession and Handover

  • Possession timelines will be communicated clearly in the Sale Agreement or Allotment Letter.

  • Delays caused by natural disasters, government intervention, legal orders, or other Force Majeure conditions shall not be considered default by the company.

  • Handover of the property will be done only after full and final payment and signing of all relevant documentation.


7. Transfer and Cancellation Policy

  • Property transfer is allowed subject to management approval and applicable transfer charges.

  • In case of cancellation by the buyer:

    • The booking amount is non-refundable.

    • Any refund request (in case of overpayment or cancellation) will be processed within 30 working days after verification.

    • Deductions for administrative, legal, and processing charges will apply.

  • In case of default by DS Infra Developers, a full refund will be issued as per the agreement terms.


8. Resale and Third-Party Transactions

  • DS Infra Developers shall not be responsible for any resale, third-party transaction, or sub-sale conducted by the buyer after purchase.

  • Any resale must be registered and follow government and RERA norms.

  • The company holds no liability for unauthorized or disputed resales.


9. Use of Website and Digital Content

  • The website of DS Infra Developers and its content (including property listings, blogs, videos, etc.) are protected by copyright.

  • You may not copy, duplicate, download, or distribute our content for commercial use without written permission.

  • The company is not liable for any third-party links, promotions, or ads appearing on the site.


10. Privacy and Data Use

  • DS Infra Developers respects your privacy. All customer data collected via forms, WhatsApp, calls, or in-person visits is kept confidential and used only for communication, documentation, and project updates.

  • We do not sell or rent your personal data to third parties.

  • We may use your contact details to send updates, offers, and project information unless you choose to opt-out.


11. Dispute Resolution and Jurisdiction

  • Any dispute, disagreement, or legal matter arising out of a property transaction, booking, or communication with DS Infra Developers shall be resolved amicably, failing which it shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh.

  • Mediation or arbitration may be proposed before resorting to legal proceedings.


12. RERA Compliance

  • DS Infra Developers operates in accordance with the Uttar Pradesh Real Estate Regulatory Authority (UP RERA).

  • All projects that fall under the RERA guidelines are duly registered and carry a RERA number.

  • Buyers are encouraged to verify RERA registration and documentation before booking.


13. Disclaimer of Liability

  • DS Infra Developers does not guarantee any fixed return, appreciation, or resale value unless specifically mentioned in a legal agreement.

  • Real estate investments are subject to market risks and regulatory changes.

  • The company is not liable for losses arising from third-party agents, brokers, or any false representation made by unauthorized individuals.


14. Amendment of Terms

  • DS Infra Developers reserves the right to revise these Terms & Conditions at any time without prior notice.

  • Any updates will be published on our website and shall be effective immediately upon publication.

  • Users are advised to periodically review these terms to stay informed.
